Fillable Proofs of Service Forms

The California Judicial Council Proofs of Service forms may be filled in online, then printed out for signature. All Judicial Council forms are posted online here. Many superior courts post forms online that can be filled in or printed. For convenience, you may save a blank form on your local hard drive and fill them in offline. If you have Adobe Acrobat, you can save the document as a file and archive your proofs of service. There are other PDF writing programs that have fewer or alternative features that do it at a fraction of the price of Acrobat.

We have added some commonly used Fillable Non-Judicial Council forms on this page. Forms for use in federal courts and other states are included. Process Server Institute publishes a guide, Affidavit and Proof of Service Requirements Guide, California Edition which describes how to correctly fill out these proofs of service, and the requirements in each state, Canada, and the apostille process required for affidavits of service for actions served that are pending in courts of foreign countries.

Form Name - Judicial Council form NumberWhen to Use It
POS-010 Proof of Service of SummonsThis form is a Mandatory Form and must be used for service of a summons - only.  A computer generated form may be used if it complies with California Rule of Court 2.150.  The form must number the items and language consistent with the POS-010 form.
POS-020 Proof Of Personal Service -Civil (Proof of Service) This form is Approved for Optional Use and could be used for serving documents, other than a summons, by personal service.
POS-030 Proof Of Service By First-Class Mail-Civil (Proof of Service) This form is Approved for Optional Use and could be used for serving documents, other than a summons, by mail.
POS-040 Proof Of Service - Civil (Proof of Service) This form is Approved for Optional Use and could be used for serving documents, other than a summons, by personal service, mail, overnight delivery, messenger service, fax, or e-mail.
SC-104 Proof of Service (Small Claims)This form is Approved for Optional Use and could be used for serving small claims documents.
FL-115 Proof Of Service Of Summons (Family Law-Uniform Parentage-Custody and Support) This form is not a Mandatory Form but should be used for service of family law summonses. A computer generated form may be used if it complies with California Rule of Court 2.150. The form must number the items and language consistent with the FL-115 form.

Landlord / Tenant
Form used for unlawful detainer cases only. The Proof of Service of Summons is used for service of all California summonses that have a capacity notice.

This proof of service may be used for personal, substituted service and mailing, or posting and mailing of a `15-Day Notice. The names of the forms are those developed by the California Apartment Association. If the landlord titles the notice(s) differently, use the previous form.

Declaration re DiligenceThis form is used to state the dates and times service was attempted when a substituted service is made. It may also be used as a "Non-Estes Return" or "Not Found Return" when service cannot be completed.
Application for Service by Publication and Order for Service by PublicationThis LA Superior Court form can be used in any other venue by changing the county. It must accompany a Declaration re Diligence and a declaration re efforts to locate the defendant and may be submitted to court for an Order to Serve by Publication.

Writ Proofs of Service forms
These forms may be used for service of Bank and Real Property Levies, and Wage Garnishments.  We recommend a review of The Registered Process Server's Guide to Service of Writs of Attachment and Writs of Execution before using these forms.

Proof of Service on Garnishee - Bank LevyThis form is used to show service on a Garnishee when serving a bank, but could also be used when serving a Garnishee in another type of levy.
Proof of Service on Debtor - Bank LevyThis form is used to show service on a Debtor or Third Party.
Proof of Service on Occupant - Real Property LevyThis form is used to show service on an Occupant in a real property levy.
Proof of Recording - Real Property LevyThis form is used to show the recording information of the documents in a real property levy.
Proof of Service on Employer - Wage GarnishmentThis form is used to show the service of an employer when serving a wage garnishment.

    What happens when Landlord files Unlawful Detainer but never serves the tenant.

    However, Landlord then files fraudulent forms with court indicating that service was performed – when in fact, there was no service performed.

    What can tenant do? to prove they were never served?
    How should tenant proceed?
